Bill 168 (Workplace Violence and Harassment), amendments to Ontario’s Occupational Health & Safety Act.
Bill 168, the Occupational Health and Safety Amendment Act (Violence and Harassment in the Workplace) 2009, received Royal assent from the Ontario government on Dec. 15, 2009.
The amendments impose new obligations on employers to incorporate protection for workers and others in the workplace against violence and harassment.
The Bill, which comes into force on June 15, 2010, requires employers to develop workplace violence and harassment policies, create programs to implement those policies, provide reports for incidents of violence and harassment, and engage in surveys to measure the risk of workplace violence. Of special note is the right of workers to refuse work if they feel they are in an unsafe situation because of the potential for a violent situation arising.
Your workplace regardless of size or type must be compliant by June 15, 2010.
